These Terms govern access to and use of alemotions.com (the “Site”), its content, forms, and The Alemotions Diagnostic™, operated by Alemotions LLC (“Alemotions”), a Florida limited liability company. By using the Site, you agree to these Terms. If you disagree, do not use it.
The Site is intended primarily for founders, leaders, and organizational representatives. You represent that you are at least 18 or have sufficient legal capacity, that submitted information is reasonably accurate, that you are authorized to provide it, and that you will use the Site lawfully.
The Alemotions Method™ and The Alemotions Diagnostic™ were developed by Alemotions based on its founder’s professional experience, organizational knowledge, strategic judgment, and proprietary approach. Alemotions defines and selects their phases, structure, dimensions, questions, answers, three indicators, criteria, scoring logic, bands, interpretations, and presentation.
The Alemotions Method™ includes Envision, Design, Align, and Evolve. The Alemotions Diagnostic™ is a tool associated with Envision. The constellation is a visual representation of the indicators, not an independent methodology.
Original content, visual identity, marks, text, graphics, questions, results, reports, and documentation are owned by Alemotions or used under license and protected to the extent permitted. The ™ symbol indicates a claim of rights, not necessarily registration.
You may access the Site, complete the diagnostic, download results, and use them internally for non-commercial purposes. Without written authorization, you may not copy, sell, license, translate, adapt, extract, scrape, create derivatives, remove notices, claim materials as your own, or use them to develop, train, or improve a competing product, model, database, diagnostic, or service.
You retain your rights in submitted information and grant Alemotions a limited license to host, store, organize, technically reproduce, analyze, and process it as reasonably necessary to operate the Site, deliver results, prepare reports, maintain security, improve services, create de-identified analysis, comply with law, and provide authorized services.
You represent that you have authority. Do not submit passwords, credentials, sensitive financial or health information, regulated data, or content infringing third-party rights.
We apply reasonable measures, but public forms are not channels for trade secrets or highly sensitive information. Submission does not itself create a contractual confidentiality duty, fiduciary relationship, professional privilege, or Mutual NDA protections. Where needed, the parties may execute a separate agreement.
The diagnostic applies criteria and combinations previously established by Alemotions to selected answers. Results vary by participant, use three indicators developed by Alemotions, and may include a constellation and personalized PDF displaying the participant’s name.
Calculation and delivery may be automated. Technology executes predefined rules and does not independently interpret each result. The assessment is general, depends on the accuracy and context of answers, and is not a comprehensive audit.
The diagnostic is not customized business, legal, tax, accounting, financial, investment, technology, human resources, or cybersecurity advice. Do not make significant decisions based exclusively on a result.
Site use, submission, or receipt of results does not create a consulting, advisory, fiduciary, or attorney-client relationship or an obligation to provide services. A professional relationship arises only through an accepted written agreement.
Alemotions may use tools, automated workflows, storage, and document-generation services to support processing, organization, presentation, storage, and delivery. Some providers may incorporate artificial intelligence. Any such use is instrumental and operational: they are not authors or owners of The Alemotions Method™ or The Alemotions Diagnostic™, do not conduct the individualized assessment, and do not determine its structure, methodology, scoring, or results.
Alemotions may use aggregated or reasonably de-identified information to improve its method and diagnostic, create benchmarks, identify trends, publish insights, and develop content, products, and services without publicly identifying a person or organization. Voluntary suggestions may be used to improve services without compensation.
You may not use the Site unlawfully, impersonate others, interfere with security, introduce malicious code, access systems without authorization, circumvent controls, use bots, scrape, extract proprietary data or content, overload infrastructure, defraud others, or build competing products.
We may modify, suspend, or discontinue the Site or diagnostic. We do not guarantee availability, preservation of results, continuation of versions, or error-free operation. Save your results. We may block abusive or unlawful use.
Alemotions may introduce paid products, subscriptions, or services. Prices, payment, cancellation, refund, and additional terms will be presented before purchase. A free diagnostic does not create a right to future versions or paid services without charge.
The Site and diagnostic are provided “as is” and “as available,” without warranties of accuracy, completeness, availability, merchantability, fitness, non-infringement, compatibility, absolute security, or specific outcomes. We do not guarantee growth, profitability, efficiency, AI readiness, or transformation.
To the fullest extent permitted, Alemotions and its members, employees, contractors, representatives, and providers are not liable for indirect, incidental, special, consequential, or punitive damages; loss of revenue, profit, data, reputation, or opportunities; decisions based on results; interruptions; or third-party conduct outside our reasonable control.
Aggregate liability will not exceed the greater of US$100 or the amount paid directly for the product or service giving rise to the claim during the preceding six months. Nothing excludes liability that cannot legally be excluded.
To the extent permitted, you agree to indemnify Alemotions for reasonable claims arising from unlawful use, violation, unauthorized information, third-party infringement, or unauthorized commercialization, except to the extent directly caused by Alemotions’ gross negligence or willful misconduct.
The Site may rely on external providers and links. We do not control their terms, availability, or practices. Data processing is governed by our Privacy Policy.
These Terms do not replace a proposal, Professional Services Agreement, Statement of Work, or Mutual NDA. The specific agreement controls its services.
We may suspend access for violation, abuse, or risk and update these Terms. The “Last updated” date identifies the current version and is not an expiration date. Provisions intended by their nature to continue will survive.
These Terms are governed by Florida law. To the extent permitted, disputes will be brought exclusively in state or federal courts in Miami-Dade County, Florida, without limiting mandatory applicable rights.
If a provision is invalid, the remainder continues. Failure to exercise a right is not a waiver. You may not assign these Terms without permission; Alemotions may assign them in a reorganization or transfer. These Terms and the Policy are the general Site agreement. Communications may be electronic.
The English and Spanish versions are intended to express the same conditions. If a material inconsistency exists, the English version governs unless applicable law or mandatory rights require otherwise.
